We may not know everything that ex-Detroit mayor Kwame Kilpatrick is thinking as he sulks behind bars in Milan federal prison.

But one thing is certain: HE WANTS OUT!

After repeatedly being told by U.S. District Judge Nancy G. Edmunds  that he must remain behind bars pending sentencing, he asks again to go free. 

This time, his new attorney Harold Gurewitz has filed a motion with the U.S. Court of Appeals asking that Kilpatrick go free so he can have surgery on his knee he injured while getting into a U.S. Marshals van on the day he was convicted of public corruption counts in March.  Gurewitz reiterates that his client is not a risk of flight, particularly with his knee problem.

Gurewitz's motion, filed Saturday, excerpts a letter from Kilpatrick's physician: 

Mr. Kilpatrick had evidence on both exam and his MRI for a quadriceps tendon rupture. I recommended a surgical repair. The quadriceps tendon will require sutures to be anchored to the patella. His delayed presentation increases the difficulty of the repair, which may require augmentation of the repair with donor tendon/bone graft. This also increases his postoperative risk of repeat tear, stiffness, weakness of his quadriceps, limp, need for assistive device for ambulation (crutch/walker).

His detention at the Milan Correctional Facility also presents challenges for his post-operative recovery. He will require 1-2 days in the hospital post operatively for antibiotics and pain control. He will have limited mobility and will be in a brace that prevents bending his knee when walking. He will begin physical therapy 2-3x week for 2-3 months after his post-operative appointment with me. His ultimate recovery will take at least one year for maximal medical improvement. He is at risk for infection, stiffness, re-tear, blood clot, bleeding
and weakness.

Gurewitz writes:

It is submitted that Mr. Kilpatrick’s medical condition as described by the doctor presents substantial and additional information upon which to conclude that he is not a risk of flight.
