Shirvell AndrewEven though he was canned for misconduct, a former Michigan assistant attorney general deserves state unemployment benefits, a judge says.

Andrew Shirvell's jobless pay application originally was rejected because of the reason he's out of work. While working for the state, he was accused of stalking and harassing former University of Michigan student body president Chris Armstrong, who is gay. A federal court jury earlier this year awarded Armstrong $4.5 million in a lawsuit against Shirvell. 

Ingham County Judge Paula Manderfield recently ruled that Shirvell should get unemployment benefits because he “was fired for constitutionally protected speech” rather than misconduct.
